The law on wills, estates and inheritance stipulates that individuals have the right to dispose of their property through a will, and the division of inheritance can be according to a will or according to the law.

1. Legal Regulations on Wills, Estates, and Inheritance

1.1 Regulations on Wills

According to the Vietnam Civil Code 2015, a will is a legal document that expresses an individual’s wishes regarding the transfer of their assets to others after their death.

- Types of Wills:

· Written will without witnesses

· Written will with witnesses

· Written will notarized or certified

· Oral will (only valid in emergencies, with at least two witnesses, and must be notarized within 5 days).

- Conditions for a Legally Valid Will:
+ The testator must be mentally sound, conscious, and not coerced.
+ The content of the will must comply with the law and social ethics.
+ The will must be made in accordance with legal requirements.

1.2 Regulations on Bequests

+ A bequest is when a testator allocates a portion of their estate to a specific beneficiary.
+ Bequest recipients are not responsible for the testator's debts, unless the estate is insufficient to cover the testator’s obligations.

1.3 Interpretation of Will Contents

- If the will contains unclear terms or causes disputes, the executor and beneficiaries must jointly interpret its content based on the testator’s actual intent.
- If there is no consensus, the will may be considered invalid, and the estate will be divided according to inheritance laws.

1.4 Distribution of Inheritance by Law

- In the following cases, the inheritance is distributed according to legal provisions:
+ No legally valid will
+ The will is deemed invalid
+ The will does not cover all assets

- Heirs are categorized into inheritance ranks:

· First rank: Spouse, parents, biological and adopted children.

· Second rank: Grandparents, siblings of the deceased.

· Third rank: Great-grandparents, uncles, aunts, nephews, and nieces.

- Heirs in the same rank receive equal shares of the estate.

1.5 Acceptance or Waiver of Inheritance

+ An heir has the right to accept or refuse an inheritance (except when done to evade financial obligations).
+ A waiver must be made in writing and reported to the relevant authorities.
+ Deadline for refusal of inheritance: 6 months from the date of inheritance commencement. If no response is given within 6 months, it is considered an acceptance of the inheritance.

1.6 The Importance of Wills for Beneficiaries

+ Ensures the testator’s wishes are carried out.
+ Prevents inheritance disputes and protects family relationships.
+ Reflects the testator’s responsibility towards their family and descendants.

2. How Is an Inheritance Divided?

+ If there is a legally valid will: The estate is distributed as specified in the will.
+ If there is no will or the will is invalid: The estate is distributed according to legal inheritance ranks.
+ If a dispute arises: The competent court will resolve the case according to the law.

                                     

3. Resolving Disputes Over Inherited Real Estate

- Common causes of inheritance disputes:
+ Unclear will content.
+ Will made under duress or by an individual lacking legal capacity.
+ An heir is disqualified from inheritance.
+ Forgery, coercion, or deception in the will-making process.

- Methods for resolving inheritance disputes:
+ Negotiation and mediation among heirs.
+ Filing a lawsuit in court if no agreement is reached.

4. Wills and Inheritance Distribution

- Rights of the testator in estate distribution:
+ The testator can allocate all or part of their assets.
+ They can appoint estate administrators and distribute assets according to their wishes.
+ They may set conditions for heirs to receive their inheritance.
